The availability or use of information provided in the responses to bidder's inquiries is not to be construed in any way as a waiver of the provisions of Section 2-1.03 of the Standard Specifications or any other provision of the contract, the plans, Standard Specifications or Special Provisions, nor to excuse the contractor from full compliance with those contract requirements. Bidders are cautioned that subsequent responses or contract addenda may affect or vary a response previously given.

Q1) I would like to know if this contract requires a DBE good faith effort. The specs indicate a DBE but the Proposal and Contract book does not include any forms.

A1) Construction contracts advertised after October 2, 2006 do not include DBE goals. Refer to Section 2-1.02, "Disadvantaged Business Enterprise (DBE)," of the Special Provisions, which states, "the Department encourages the participation of Disadvantaged Business Enterprises (DBEs)." Therefore, a good faith effort is not required as a condition of award. Caltrans will continue to require the submittal of Forms CEM-2402 (F), “Final Report – Utilization of Disadvantaged Business Enterprises (DBE), First-Tier Subcontractors,” and CEM-2403(F), “Disadvantaged Business Enterprises (DBE) Certification Status Change,” on all contracts with DBE participation.
