The responses to bidder's inquiries, unless incorporated into a formal addendem to the contract, are not a part of the contract and are provided for the bidder's convenience only. In some instances, the question and answer may represent a summary of the matters discussed rather than a word-for-word recitation. The availability or use of information provided in the responses to bidder's inquiries is not to be construed in any way as a waiver of the provisions of Section 2-1.03 of the Standard Specifications or any other provision of the contract, the plans, Standard Specifications or Special Provisions, nor to excuse the contractor from full compliance with those contract requirements. Bidders are cautioned that subsequent responses or contract addenda may affect or vary a response previously given.
Q) Request that additional time be provided to allow for Steel Rail and Post procurement. Due to suppliers not able to obtain the required raw material, the Steel post and rail required for this project will not be delivered until the end of October, '04.
A) Please reference Section 8-1.07, "Liquidated Damages," of the Standard Specifications.
Q) 100-150 mm of Class 2 Aggregate Base exists under the Shoulder Paving. This material has a Salvage Value. (We have) just completed a like project and found this not to be the case. There was no Class 2 Base under the shoulder. The material encountered was native type soil and had no value. It is very possible that the existing material on this project is the same and will have no salvage value. However to bid it as if it had no salvage value would put (us) at a disadvantage. Unless we hear otherwise we will assume that Class 2 base exists under the shoulder to be removed. In the event Class 2 base does not exist, it would become a differing site condition.
A) Please reference Section 2-1.03, "Examination of Plans, Specifications, Contract, And Site Of Work," paragraph 10 of the Standard Specifications. It is important to note that the Department does not place any value on that material to be disposed of outside the highway right of way nor does it expect the material to have remained unchanged over the years due to factors such as weather in addition the actual removal process will change the character of the removed material.
